Nicole Derden, immigration attorney from Meridian, is opening a law firm on Dec. 7 in Hailey. Derden was able to secure a suite in the building where Shorty’s Diner is located — about a block from the Blaine County Courthouse.
Because of a shortage of attorneys focusing solely on immigration in south-central Idaho, a Meridian attorney is opening up a law firm in Blaine County.
Immigration attorney Nicole Derden is opening a law firm on Dec. 7 in Hailey after doing a survey that showed a large amount of immigration clientele are traveling from Blaine County and the Magic Valley areas.
Derden graduated from the University of Idaho College of Law in 2004 and opened her practice, Derden Law, in January 2009 with a focus on Idaho’s immigrants. She worked alongside her brother-in-law, Michael Derden, for five years before the practice grew too large for one location and they went their separate ways.
“It’s been 100% immigration law since 2004,” Derden told the Times-News. “If you have a notice of deportation, I know exactly how those processes work in Idaho.”

In the survey, Derden says about 10% of clientele are coming from Blaine County but the rate increases to about 25% when you add community members from the Magic Valley.
In the past few years, however, Blaine County has seen a large increase in immigrants from South America. By adding a law firm in Hailey, Derden’s law firm will be one of two in the area that will offer bilingual services.
The Alliance of Idaho, a nonprofit organization, has been a front-runner in providing legal services in the Wood River Valley for many community members. Co-founder of the nonprofit, Sarah Sentilles, said that many have gone to them because they haven’t been able to find anybody else.
“Hopefully we’ll be able to collaborate and work together. That would be good,” Sentilles told the Times-News in a phone call. “It’s always great to have more than just one so that people can get second opinions and it will just help ease the workload a little bit.”
Based on a search through the Idaho chapter of the American Immigration Lawyers Association. Derden said it shows 50 members who solely focus on immigration services. Six of them were in the south-central Idaho area, but there could be more that aren’t members of AILA.
“Immigrants live among us everywhere, every day. The U.S. immigration law is extremely complex, difficult, expensive, and changes frequently,” Derden said. “But I have always been busy because there is a shortage of attorneys who focus 100% of their practice on immigration law in Idaho.”
Derden secured a suite in the building where Shorty’s Diner is located — about a block from the Blaine County Courthouse. Her concept started in October and she secured the suite in November.
“I’m scheduled to be up in Blaine County for approximately four days a month,” Derden said. “So it’s going to be every other Thursday and Friday.”
What are your rights?
If arrested by immigration, a person being detained has rights they need to be aware of, immigration attorney Nicole Derden said.
If someone is arrested by immigration:
- They have a right to be reviewed for release — either “on their own recognizance” or by paying a bond — if they qualify.
- They have a right to see an immigration judge to defend their presence in the U.S. before being ordered deported.
- They have a right to review the charges and accusations against them and to respond to them.
- They have a right to bring an attorney to their deportation hearings to represent them.
- They have a right to give testimony in their case.
“The immigration courts will send all notifications to the address to a person and they will provide an interpreter, but sometimes people don’t know what lawful status they qualify for, or don’t know how to fill out the English-only forms and applications,” Derden said in an email to the Times-News. “They need an attorney to assess their options and let them know what they can do.”
Never have someone fill out your forms in English who doesn’t know the exact laws or whether you qualify for the application, she said. Only an immigration attorney can do that.
Although she won’t be at the Hailey office frequently, she encourages clientele to reach out to her Meridian office for scheduling.
Derden will have staff in Hailey for anyone who has questions before their consultation. This would include topics of lawful immigration status, a change in status, who wants to become a U.S. citizen, or currently in deportation proceedings needing an immigration attorney.
She also anticipates appointments will be two weeks out, and that clientele will be required to pay before the appointment.
“I will have staff there in a part-time capacity from Monday to Thursday in the afternoons,” Derden said. “So clients can walk in and make an appointment, drop off documentation or make a payment on their case.”
All staff members will be bilingual, making it easier for clients who speak only Spanish and hoping to give clients an authentic representation and understanding of their case.
“I’m hoping that my presence in Hailey will help more people understand their rights and their options in the immigration law. I want to see people who would not come to see me in the past because my office was too far away,” Derden said in an email. “Now we can do things quickly, usually with just a 1-hour appointment in downtown Hailey.”
Derden can help families in court, but she has dedicated herself to immigration only, so she doesn’t normally work on cases in criminal or civil state court.
