Erie County Attorney’s Office failed to collect $611,000

The Erie County attorney‘s Office failed to collect $611,000 in reimbursements owed to the county for its payments to programs that provide lawyers for poor clients who can’t afford an attorney, according to an audit by the county Comptroller’s Office.

The county department did not recognize or pursue nearly $482,000 in reimbursements owed to the county from the state, the audit concluded. It also failed to recover $130,000 paid to the Legal Aid Bureau of Buffalo that should have been reimbursed.

The Erie County Comptroller’s Office this year began examining how arts and cultural groups have spent millions of dollars in county grants, totaling more than $7 million a year. It found some troubling expenditures.

“The good thing is, we’re going to get back most of this money,” said Comptroller Kevin Hardwick. “We’re going to be aggressively pursuing the reimbursement that we should get. This is more than half a million dollars that would have been lost.”

The audit released this week looked at indigent legal services grants involving the county’s law department from 2015 through 2022. It found that money owed to the county from the state for two major claims was never collected because of missing or incomplete paperwork. Another case involved a claim for $19,050 that languished for seven years, resulting in the county being unable to belatedly recover those funds.

“We are in a position to rather easily resolve most of these issues with only $19,050 of the $611,824 uncollectable,” County attorney Jeremy Toth said in his audit response letter, adding that “given the enormous dollar amount of funding that flows in and out of this office for these programs, this is literally a very small fraction.”

Legal representation for low-income residents facing criminal charges comes from both the Legal Aid Bureau of Buffalo and the Erie County Bar Association’s Assigned Counsel Program. The county pays for the bulk of the costs associated with these programs and is reimbursed for its expenses from the state. But the Comptroller’s Office found that a number of the county’s reimbursement claims either weren’t made or weren’t processed because they weren’t complete.

Money owed by Legal Aid

Aside from money owed by the state, this audit also found that the County attorney‘s Office overpaid the Legal Aid Bureau for amounts totaling $130,050. The bureau received a Payroll Protection Program loan from the federal government that covered bureau personnel expenses and should not have been paid for that again with county money, according to the audit.

Overpayments are supposed to be reimbursed by Legal Aid but never were, and the county never followed up to request that money back, according to the Comptroller’s Office.

A related audit done of the County attorney‘s Office over the summer also found the Legal Aid Bureau failed to reimburse the county for $555,140 in surplus money that it should have returned in 2020 and 2021.

David Schopp, executive director of the Legal Aid Bureau of Buffalo, said the bureau has always been aware that it has excess funds that are technically owed back to the county.

More than $114,000 in cash has gone missing from the Erie County Clerk’s Office since January of last year, and County Comptroller Kevin Hardwick said he’s concerned a thief is still working in county government despite mounting evidence of fraud.

“If the county wants it all back, we can pay it back tomorrow,” he said. “We have never intended to just keep money from the county.”

The agency’s contract with Erie County allows the Legal Aid Bureau to carry over some surplus money if the county administration is in agreement, but due to administrative turnover and delays associated with the audits done this year, he said, the agency’s meeting with the county to settle on repayment has not occurred for several years. A meeting between the county and Legal Aid Bureau is scheduled for early next year, he said.

Fixing the problem

In a four-page audit response to the Comptroller’s Office, Toth agreed that his law department failed to collect the money owed and said the department “will immediately take steps to follow your outlined recommendations” to recover the money owed from the state and the Legal Aid Bureau and improve its claims handling process.

Auditors recommend that quarterly reviews be done to routinely follow up on any outstanding and unresolved claims. In addition, auditors found that supporting documentation for the claims was not retained, either in paper or electronic form, and recommended that the law department retain such documents for six years, as required.

Auditors also faulted the Comptroller’s Office’s own Accounts Payable Division for approving payment transactions without verifying whether supporting documentation was provided.

While the county attorney generally agreed with the audit findings, he said in his response letter that his department is hamstrung by the lack of a dedicated accountant for this work. An accountant will be added to the law department next year. He also said the funding of indigent legal services is extremely complicated, and the fact that only a small fraction of the claims were problematic is a sign of the solid work done by the department overall.

Deputy Budget Director Mark Cornell said the county should be able to get reimbursed fairly easily. Both he and Toth also said they are going to start storing supporting required documentation in digital form instead of getting rid of huge stacks of paper documents by shuffling it on to the state, as it has in the past.

Attorneys spar over defamation, Free Speech in politics

In a bid to see Maricopa County Recorder Stephen Richer’s defamation lawsuit dismissed, attorneys for Kari Lake claimed her statements accusing him of election interference, though sewn with some “rhetorical hyperbole,” are still “based on provable facts” and are therefore protected speech.

But attorneys for Richer argued in a Maricopa County Superior Court hearing Tuesday that Lake’s list of specific criminal allegations do not hold constitutional muster.

“The First Amendment gives defendants the right to criticize Stephen Richer’s election, administration, his political views and even his hair,” Cameron Kistler, attorney for Richer, said. “But the First Amendment does not give defendants the right to falsely and repeatedly accuse Stephen of committing specific unlawful acts.”

Beyond the specific contours of the case, attorneys for both Lake and Richer hope the case sets some sort of precedent.

In Lake’s case, her attorneys hope to cement political speech protections under Arizona’s recently enacted anti-strategic lawsuits against public participation, or anti-SLAPP law. And as for Richer, his attorneys hope the case shows defamation law can still operate in cases involving elections.

Maricopa Couty Superior Court judge Jay Adleman heard arguments on whether to dismiss Richer’s defamation lawsuit.

Lake’s attorneys, aided by Arizona State University’s First Amendment Law Clinic, claim Richer cannot overcome free speech protections and Arizona’s anti-SLAPP law, which mandates the dismissal of a lawsuit given proof the action was, “substantially motivated by a desire to deter, retaliate against or prevent the lawful exercise of a constitutional right.”

Jen Wright, attorney for Lake, contended Richer fails to establish actual malice as Lake believed what she was saying and couldn’t have known or had reason to know her statements were false.

“Largely, the facts are true,” Wright said. She points particularly to Lake’s claims that upwards of 275,000 ballots lacked proper chain of custody, as well as her speculation around the widespread failure of Maricopa County ballot-on-demand printers on election day.

Wright argued, though the Arizona Court of Appeals did not find the chain of custody convincing enough to overturn the election did not necessarily mean the claim was untrue. And as for the failure of ballot-on-demand printers, she noted the instances were “actually true,” and provable.

She conceded Lake engaged in “rhetorical hyperbole” in using words like “injected,” “bogus,” and “sabotage.” But she argued Lake’s speech was still protected, especially given grave public concerns around elections.

“We don’t disagree on the facts, “Wright said. “What we disagree on is how Kari Lake’s opinion of those facts relates to (Richer) and whether or not that … rises to the level of a defamation case”

But Richer’s attorney contends they do not agree on the facts.

“I’m not quite sure where they’re getting from the Court of Appeals … that determined that statement was factually true,” Kistler said. “We respectfully submit that the Achilles heel of defendants’ motions to dismiss is that they defend a sanitized version of defendants’ remarks.”

Kistler went through statements from Lake and her campaign he said directly lodged criminal allegations against Richer.

As for the anti-SLAPP law, Jessica Banks, a second-year law student at ASU’s First Amendment Clinic, argued Richer’s lawsuit is intended to deter and chill Lake’s speech, necessitating its dismissal under statute.

And she pointed to the request for an injunction on Lake’s claims as proof of intent to limit Lake’s protected political speech.

Laurence Schwartztol, an attorney for Richer, claimed the interpretation made the anti-SLAPP statute a “get-out-of-defamation free card.”

Gregg Leslie, executive director for the ASU First Amendment Clinic, said they intend to see the case through to the appellate levels, but only in arguing on the anti-SLAPP law.

He said the case is important in establishing clarity on exactly how the anti-SLAPP law works to protect speech.

“You’re just not going to be a good, honest First Amendment clinic if you pick political sides,” Leslie said. “I have no regrets of having our clinic take this on.”

Ben Berwick, attorney for Richer, said he hopes the case shows defamation cases can still hold water in the election contest and ensure election officials and workers are “not without recourse.”

“Everybody has a free speech right to criticize public officials, to insult them, to say they are doing a bad job, to say the most vile things about them but there has never been a right to spread false information and false accusations,” Berwick said. “Frankly, it should serve as a warning to those who are in the business of spreading disinformation about elections that if they are going to do it in a way that makes specific false allegations against specific officials or specific election workers, they will pay a cost.”

If the case is not dismissed, Wright said they expect to “relitigate” the 2022 election and asked the court to stay discovery while a ruling is pending.

What Is a Power of attorney?

A power of attorney is a legal document where one person, referred to as the principal, gives another person, known as the “attorney-in-fact,” authority to make decisions for them. Powers of attorney can be “durable,” which means they are still in effect if the principal becomes incapacitated or unable to make decisions. How to Create a Power of attorney in New Mexico

In order for a power of attorney to be valid in New Mexico, it must be in writing and contain all of the following:

The name of the agent or attorney-in-fact
The scope of the POA, meaning the rights and responsibilities the principal is assigning to the agent or attorney-in-fact
The principal’s signature which must be notarized
The date of execution

In addition, the principal must be competent to grant the power of attorney. Being competent—sometimes called being “of sound mind”—means having sufficient mental capacity to understand what they’re doing and being able to make their own decisions.

Types of Powers of attorney

Principals can choose from several types of powers of attorney. But, generally speaking, there are two different categories of powers of attorney:

those based on mental soundness and
those based on what they do and don’t cover.

Capacity-Based Powers of attorney

Protecting assets if someone becomes incapacitated is one of the main reasons for creating powers of attorney. That’s why many POAs are designed based on the capacity of the principal.

Durable Power of attorney. Here, the principal intends for the authority granted to the agent to continue even after they become incapacitated. Durability is presumed in New Mexico, which means a POA will automatically remain effective if the principal becomes incapacitated or disabled.
General Power of attorney. A general (or “non-durable”) power of attorney can only be created when the principal is competent. If the principal becomes incapacitated, the POA is no longer effective.
Springing Power of attorney. Here, the POA only becomes effective if the principal becomes disabled or incapacitated. It’s also sometimes called a “standby” power of attorney.

Scope-Based Powers of attorney

These powers of attorney are confined to a specific task or situation. They can be as narrow as a POA to sell a specific piece of property or asset. Or, they can be as broad as granting the agent the power to act in all financial matters for the principal.

The medical power of attorney (which is part of the state health-care directive form) is perhaps the best-known scope-based power of attorney. This document grants the agent the power to make medical decisions on behalf of the principal. Typically, this is when principals cannot make those decisions themselves.

Who Can Be an attorney-in-Fact?

Short answer: Anyone can serve as an attorney-in-fact. Also called an agent, this person should be someone you trust to make critical decisions, such as an adult child, close friend or family member. If the principal has the capacity, they choose their own agent. If they are incapacitated, the court may appoint one on their behalf.

Principals may also select alternate attorneys-in-fact in the event the primary is unavailable. However, they should not choose co-agents, which can lead to disagreements that cause delays in decision-making.

What Are the Signing Requirements for a Power of attorney Form in New Mexico?

Who must sign a power of attorney and other requirements vary by state. In New Mexico, a power of attorney form must be notarized. If the document is notarized, it is presumed to be genuine.

Do You Need a Lawyer to Get a Power of attorney in New Mexico?

You can use a template like the one provided above to create a perfectly legal power of attorney in New Mexico. You could even write one without a template, as long as it meets all the legal requirements.

Who can override a power of attorney?

There are only two ways to override a power of attorney. The principal can override the POA—called “revocation”—as long as they are of sound mind. A revocation must be in writing and clearly express the intention to end the specific power of attorney.

Types of Powers of attorney

Principals can choose from several types of powers of attorney. But, generally speaking, there are two different categories of powers of attorney:

those based on mental soundness and
those based on what they do and don’t cover.

Capacity-Based Powers of attorney

Protecting assets if someone becomes incapacitated is one of the main reasons for creating powers of attorney. That’s why many POAs are designed based on the capacity of the principal.

Durable Power of attorney. Here, the principal intends for the authority granted to the agent to continue even after they become incapacitated. Durability is presumed in Colorado, which means a POA will automatically remain effective if the principal becomes incapacitated or disabled.
General Power of attorney. A general (or “non-durable”) power of attorney can only be created when the principal is competent. If the principal becomes incapacitated, the POA is no longer effective.
Springing Power of attorney. Here, the POA only becomes effective if the principal becomes disabled or incapacitated. It’s also sometimes called a “standby” power of attorney.

Scope-Based Powers of attorney

The medical power of attorney is perhaps the best-known scope-based power of attorney. This document grants the agent the power to make medical decisions on behalf of the principal. Typically, this is when principals cannot make those decisions themselves.

Who Can Be an attorney-in-Fact?

Nearly anyone can serve as an attorney-in-fact. They do not need to be an actual attorney. They do, however, need to be a legal adult and not otherwise incapacitated.

Ensure that the attorney-in-fact is someone you trust. Note that principals may also select backup attorneys-in-fact, in case the primary is unreachable.

Google Play Store settles anticompetitive conduct lawsuit with Attorneys General for $700M

SALT LAKE CITY, Utah, Dec. 20, 2023 (Gephardt Daily) — Utah attorney General Sean D. Reyes and a bipartisan group of 52 other attorneys general on Tuesday announced a $700 million agreement with Google in their lawsuit concerning Google’s anticompetitive conduct with the Google Play Store.

“The States are fiercely fighting the greed and abuses of certain Big Tech on multiple fronts,” Reyes said in a news release issued by his office. “Utah has been a leader and driving force in holding Google accountable for the past 10 years. This was evident again on this case as our fantastic AG antitrust team was one of the first and loudest advocates for investigating and litigating payments on Google Play.

“When many experts and other states were hesitant or even opposed, Utah pushed to start the case and has helped navigate it towards resolution in spite of the risks and Google’s massive defense. We are most pleased the settlement includes many of the injunctive remedies we sought that will change Google’s behavior. The dollar amounts are an added bonus to provide relief to Utahns who use Android apps.”

Google will pay $630 million in restitution, minus costs and fees, to consumers who made purchases on the Google Play Store between August 2016 and September 2023 and were harmed by Google’s anticompetitive practices, the statement says.

Google will pay an additional $70 million directly to the involved states. People eligible for restitution do not have to submit a claim – they will receive automatic payments through PayPal or Venmo, or they can elect to receive a check or ACH transfer, the news release says.

More details about that process will be forthcoming, says the issued statement. The agreement also requires Google to make their business practices more pro-competitive in several important ways.

Utah is expected to receive a total of approximately $15 million between payments that will go to consumers and payments directly to the States.

The attorneys general sued Google in 2021, alleging that Google unlawfully monopolized Android app distribution and in-app payment processing. Specifically, the States claimed that Google signed anti-competitive contracts to prevent other app stores from being preloaded on Android devices, bought off key app developers who might have launched rival app stores, and created technological barriers to deter consumers from directly downloading apps to their devices. The States announced a settlement in principle on Sept.r 5, 2023, and today released the finalized terms of that deal.

The settlement requires Google to reform its business practices in the following ways:

Give all developers the ability to allow users to pay through in-app billing systems other than Google Play Billing for at least five years.
Allow developers to offer cheaper prices for their apps and in-app products for consumers who use alternative, non-Google billing systems for at least five years.
Permit developers to steer consumers toward alternative, non-Google billing systems by advertising cheaper prices within their apps for at least five years.
Not enter contracts that require the Play Store to be the exclusive, pre-loaded app store on a device or home screen for at least five years.
Allow the installation of third-party apps on Android phones from outside the Google Play Store for at least seven years.
Revise and reduce the warnings that appear on an Android device if a user attempts to download a third-party app from outside the Google Play Store for at least five years.
Maintain Android system support for third-party app stores, including allowing automatic updates, for four years.
Not require developers to launch their app catalogs on the Play Store at the same time as they launch on other app stores for at least four years.
Submit compliance reports to an independent monitor who will ensure that Google is not continuing its anticompetitive conduct for at least five years.

For much of this case, the attorneys general litigated alongside Epic Games and Match, two major app developers. Match announced a separate settlement earlier this year, while Epic Games took its case to trial. A jury unanimously found that Google’s anticompetitive conduct violated federal antitrust laws early last week.

This lawsuit was led by the attorneys general from Utah, North Carolina, Tennessee, New York, and California, and joined by the attorneys general of all remaining states, the District of Columbia, and the territories of Puerto Rico and the Virgin Islands.

What Is a Power of attorney?

A power of attorney (POA) permits one or more persons to act on your behalf as your agent. This important lifetime planning tool may be limited to a particular activity, such as selling your home, or it can be more general in its application. The power of attorney can also be used to give temporary or permanent authority to act on your behalf.

Note that the attorney-in-fact doesn’t need to be a licensed attorney. It should, however, be someone the principal—the person granting the right to act on their behalf—trusts to make decisions on their behalf.

There are also different types of powers of attorney. They can be “durable,” meaning they remain in effect if the principal becomes incapacitated or unable to make decisions. Durable powers of attorney typically end with the principal’s death. A general power of attorney that is not durable is no longer valid if the principal becomes incapacitated.

Who Should Use a Power of attorney Form?

Anyone who wants to ensure that a specific person has the power to act on their behalf should consider a power of attorney. A POA is a powerful, viable tool in any situation where you need someone to act for you. Often this is when you face a situation where you lose your capacity to make decisions for yourself. However, it can also be used in situations where you’re not able to be present, like when you need to sell your car while you’re out of town.

If you consult with an estate planning attorney, it’s likely that they would suggest using a power of attorney as part of your estate planning strategy.

How to Create a Power of attorney in Washington

There are a few requirements needed to draft a Washington power of attorney. If you have any doubts, be sure to consult with an experienced estate planning attorney. The requirements typically are that:

The principal can make decisions for themselves
There is an actual written document
The document includes:
- The name of the attorney-in-fact
- The duties the principal gives the agent
- The principal’s signature, properly notarized

Store the original safely and regularly review your power of attorney as your life circumstances change. Consider also sending signed copies of the power of attorney documents to your attorney-in-fact, financial institution and important family members.

Types of Powers of attorney

Depending on their needs, principals can choose from several types of powers of attorney with regard to duration and scope.

Powers of attorney Based on Capacity

Principals can select a power of attorney depending on whether they want it to take effect immediately or only if they incapacitated or if they want it to end upon their incapacitation or their death.

General or Non-Durable Power of attorney. A general power of attorney gives the attorney-in-fact permission to act for the principal on a broad range of personal affairs and financial transactions. It automatically ends when the principal either becomes incapacitated or dies.
Durable Power of attorney. A durable power of attorney remains in effect if the principal becomes incapacitated. In Washington, durability is not presumed, meaning a power of attorney will not automatically remain effective if the principal becomes disabled or incapacitated.
Springing Power of attorney. Unlike general and durable powers of attorney, a springing power of attorney becomes effective only if the principal becomes disabled or incapacitated. It’s also referred to as a “standby power of attorney.”

Limited Powers of attorney Based on Scope

Limited powers of attorney, as the name suggests, give attorneys-in-fact responsibility over specific topic(s) the principal designates but do not include sweeping rights to make decisions. Common examples include:

Financial Power of attorney. With a financial power of attorney, a principal enables an attorney-in-fact to make financial decisions for them, including choices around investments, banking, real estate, loans, insurance and bill-paying.
Medical Power of attorney or Durable Power of attorney for Healthcare. A healthcare power of attorney allows an attorney-in-fact to make healthcare decisions for the principal, according to their wishes and professional medical advice, when the principal cannot do so for themselves. You may wish to nominate an alternate attorney-in-fact in case your primary one is unavailable in an emergency.

Who Can Be an attorney-In-Fact?

Despite the term “attorney-in-fact,” you don’t have to be an attorney to serve in the role. In fact, nearly anyone can be an agent or attorney-in-fact. As long as the person selected is a legal adult and competent, they can serve as an agent.

The most important qualification is not an official one—the attorney-in-fact should be someone the principal trusts. A POA can grant a lot of power to the agent, so it’s essential that the agent be a person likely to do what the principal would prefer.

What Are the Signing Requirements for a Power of attorney Form in Washington?

Signing requirements for a power of attorney differ across states. When you consider the broad powers a POA can grant, the strict requirements make sense. In Washington, the POA must be notarized or acknowledged by an individual authorized by law to take acknowledgments.

Do You Need a Lawyer to Get a Power of attorney in Washington?

You can use a template like the one provided above to create a perfectly legal power of attorney in Washington. You could even write one without a template, as long as it meets all the legal requirements.

Just because you don’t have to have a lawyer draw up your POA, though, doesn’t mean you shouldn’t have it reviewed by an attorney. A power of attorney can give sweeping powers to the attorney-in-fact, so a lawyer can ensure that it confers the authority you want to the right person.

TUCSON, Ariz. (KVOA) — News 4 Tucson has learned more about why the Pima County attorney‘s Office declined to prosecute a corrections officer arrested for organized retail theft.

The News 4 Tucson investigators broke the story after learning some sheriff department employees were concerned by the sheriff’s decision not to fire the officer.

A Pima County Sheriff’s Department Corrections Officer is used to watching over people behind bars but recently found himself in custody after allegedly committing multiple incidents of theft.

The case against the corrections officer was all detailed in a police report. This has become a very divisive topic among the sheriff’s department and has become a war of words between different unions.

On Tuesday night, The Pima County attorney gave News 4 Tucson an exclusive interview explaining why they chose not to prosecute.

“This particular case went through a first review, second review and even a third review with our bureau chief because the accused holds a position of trust in our community,” Pima County attorney, Laura Conover said.

In an exclusive interview with the News 4 Tucson Investigators, Pima County attorney Laura Conover explains why her team didn’t prosecute Jose Monreal Junior, a Pima County Corrections Officer, after he was arrested in Oct. by Sahuarita Police for multiple documented incidents of shoplifting and what officers believed warranted two felony charges.

According to the police report from Sahuarita Police, Monreal Junior was captured on Walmart surveillance video intentionally not bagging items at self-checkout 23 times over the course of three months. The total losses just under $500.

Conover says that’s the reason they didn’t pursue a felony case

“The case falls well short of the $1,000 necessary to pursue a felony conviction,” Conover said.

Conover acknowledged they could pursue it based on a pattern of behavior but it would be a daunting task.

“It would be like prosecuting 23 separate cases.”

Pima County Sheriff Chris Nanos told the News 4 Tucson Investigators that he convened a leadership panel and everyone voted to terminate Monreal’s employment, but he refused.

“The main reason for me is this is a man who has six kids, he’s the sole provider for the family of six and his wife and one of those kids is dying of cancer,” Sheriff Nanos said.

Instead, Nanos briefly suspended Monreal Jr. That decision faced scrutiny from some staff like Deputy Aaron Cross, who heads the Pima County Deputy’s organization.

“I think it’s just another poor decision by sheriff nanos and this guy needs to be fired immediately,” Cross said.

Cross’ vocal condemnation is facing its own condemnation from a different union, The Pima County Deputy Sheriff’s Association.

In a news release, it says it supports the sheriff’s decision not to fire Monreal writing in part:

“PCDSA questions why the head of other alleged employee labor organization would condemn such opportunities and create precedent for harsher punishment knowing they may one day find their members in a similar predicament.”

But, Cross isn’t backing down, sending News 4 Tucson a response reading:

“The PCDO, which represents half of all deputies, is an organization that values integrity and honor. This man has tarnished all of our badges with his continued employment, and every one of the sheriff’s senior commanders agrees, when they voted to terminate him. Sheriff Nanos and his mouthpiece from the PCDA should be more concerned with the trust the badge is meant to represent, rather than the common criminal who now, unfortunately, wears one.”

The Sahuarita Police Department and Conover say that the case is now in the hands of Sahuarita Municipal Court.

The court tells News 4 Tucson it has no record of an open case against Monreal Junior.

Colorado Trump lawsuit petitioners’ attorney: “Very good chance that we can win at the Supreme Court level”

Reactions to a Colorado State Supreme Court ruling, which could keep former President Donald Trump off the state’s 2024 ballot, are pouring in.

This ruling — if it holds — could change the course of the 2024 presidential election.

While there have been similar legal challenges in dozens of other states, the Colorado Supreme Court is the first to rule on the merits of such a case, finding that Trump engaged in an insurrection and, as such, is ineligible to ever hold any public office again.

In a 4-3 ruling, the court ruled former Trump cannot appear on Colorado’s primary ballot — a decision that’s sure to be challenged to the U.S. Supreme Court.

We look at what this decision means for voters in Colorado and the rest of the country, and what Trump’s Republican opponents are saying.

The whole country is now watching to see how this plays out.

In a 132-page opinion, the majority of Colorado Supreme Court justices noted the gravity of their decision, saying, in part, “we do not reach these conclusions lightly” noting they “travel in uncharted territory” as the first court in the nation to find Trump engaged in an insurrection.

They said they had “little difficulty” concluding, that Trump’s actions leading up to, and on Jan. 6, 2021, “constituted overt, voluntary and direct participation” in an insurrection.

But they disagreed with the lower court on whether Section 3 of the 14th Amendment of the U.S. Constitution, which bars insurrectionists from holding office, applies to presidents, saying, “President Trump asks us to hold that Section 3 disqualifies every oath-breaking insurrectionist except the most powerful one and that it bars oath-breakers from virtually every office, both state and federal, except the highest one in the land.”

They barred the Colorado Secretary of State from placing Trump’s name on Colorado’s primary ballot or counting write-in votes for him, but delayed the ruling from taking effect until Jan. 4, 2024 — when Colorado’s primary ballot needs to be set and certified.

Trump’s attorneys vowed to appeal to the U.S. Supreme Court.

“Certainly a lot of people are going to be spending the holidays thinking over this quite a bit,” said Mario Nicolais, an attorney for the a Republican and one of six Colorado voters to bring the lawsuit. Nicolais said he was confident the nation’s highest court would uphold the state court’s decision.

“One of the things that you’ll find in this ruling is some reliance is based on writings of Neil Gorsuch — Justice Gorsuch — and what he had to say about protecting ballots from people who did not belong on them,” Nicolais continued. “So I think there’s actually a very good chance we can win at the U.S. Supreme Court level.”

But the ruling wasn’t unanimous; three judges dissented.

Chief Justice Brian Boatright said removing Trump from the ballot would require, “an insurrection-related conviction,” which doesn’t exist.

Justice Maria Berkenkotter said the court didn’t have the authority to consider the case.

Justice Carlos Samour went even further saying Trump had been denied due process.

“What took place here doesn’t resemble anything I’ve seen in a courtroom,” Samour wrote. “Parties are always allowed to conduct discovery, subpoena documents and compel witnesses.”

“The irregularity of these proceedings is particularly troubling, given the stakes,” Samour wrote.

He also worried about potential chaos if other states began disqualifying Trump on an ad hoc basis. The ruling only applies to Colorado but Nicolais said other states would take notice.

“It is not binding on them, but it is persuasive authority, particularly because the Colorado Supreme Court went into such great detail on this,” he said. “They have made sure that what they’ve written, if it does get appealed, will have to focus on that.”

The ruling only applies to Colorado but other state courts, and even secretaries of state, could use the ruling as justification to keep Trump off the ballot in their states as well.

Here’s why that matters: if Trump isn’t on a state’s primary ballot, he doesn’t get delegates from that state and if enough states disqualify him, he may not have enough delegates to secure the Republican nomination.

If trump appeals but the U.S. Supreme Court doesn’t issue a ruling until after Jan. 4, Trump remains on Colorado’s primary ballot. But, if the U.S. Supreme Court upholds the Colorado State Supreme Court’s ruling, any votes for Trump wouldn’t count.

Steven Cheung, a Trump campaign spokesman, issued a written statement Tuesday evening in response to the Colorado Supreme Court ruling, saying, in part, “Democrat Party leaders are in a state of paranoia over the growing, dominant lead President Trump has amassed in the polls. They have lost faith in the failed Biden presidency and are now doing everything they can to stop the American voters from throwing them out of office next November.”
