JALEN ELMORE HAD HIS PRELIMINARY HEARING TODAY AFTER BEING CHARGED WITH ATTEMPTED CAPITAL MURDER. KMBC9 PEYTON HEADLEE WAS IN THAT COURTROOM TODAY. THIS IS DR. STAFFORD’S OFFICE, OBVIOUSLY IN A CLUTTERED CONDITION. WITNESSES TESTIFIED ABOUT WHAT THEY SAY HAPPENED INSIDE THIS OFFICE AT OLATHE EAST HIGH SCHOOL ON MARCH 4TH OF 20, 22. HERE’S THE DOOR. ASSISTANT PRINCIPALS LESLIE SIMMONS AND CALEB, STOP ALL SAY THEY PULLED 18 YEAR OLD JALEN ELMORE OUT OF CLASS INTO THE OFFICE AFTER HEARING RUMORS HE HAD A GUN IN HIS BACKPACK. YOU RECOGNIZE IT AS BEING THE GUN. THEY SAY THEY REPEATEDLY TOLD ELMORE THEY NEEDED TO SEARCH HIS BAG. EACH TIME THEY SAY, ELMORE TOLD THEM NO. AND KEPT SAYING NO. I’LL JUST GO HOME. THEN STOP, SAYS HE TEXTED THEIR SCHOOL RESOURCE OFFICER ERIC CLARK TO COME TO HIS OFFICE IMMEDIATELY. ON HAND, GUN FROM HIS BACKPACK JUST STARTED FIRING DIRECTLY OUT. THEY COULD SEE OFFICER CLARK’S REACTION WITH EACH ONE. AND I SEE THE MUZZLE FLASH. I CAN HEAR THE SOUND OF A GUN FIRING. I CAN FEEL MORE TELLING ME, OFFICER CLARK SAYS HE DREW HIS GUN AND RETURNED FIRE. IT ALL HAPPENED SO FAST THAT IT WAS BANG, BANG, THEY WERE DOWN. THE NEXT THING I REMEMBER IS I AM ON TOP OF JALEN AND I’M USING MY WEIGHT TO SUBDUE HIM. CLARK, ELMORE AND STOP ALL HAD ALL BEEN SHOT. ONE OF THE BULLETS HIT AND DESTROYED CLARK’S BODY CAM. IF THAT IS A TOP SAFETY CONCERN FOR YOU GUYS, WHY DID YOU NOT INVOLVE LAW ENFORCEMENT FROM THE BEGINNING OF THE DEFENSE QUESTION TO THE SCHOOL’S RESPONSE, ASKING IF THEY THINK THEY HANDLED THE SITUATION CORRECTLY? THEY SAID THEY DID TO THE BEST OF THEIR ABILITY, ADDING THAT NO ONE ELSE GOT HURT. RIGHT NOW, NO TRIAL DATE HAS BEEN SET, CHRIS. ALL RIGHT, PADEN, THANK YOU. ELMORE HAS PLED NOT GUILTY ON ALL FOUR COUNTS, INCLUDING TWO FELONY COUNTS OF ATTEMPTED CAPITAL MURDER AND POSSESSION OF A FIREARM BY A CONVICT

The attorneys for the suspect accused in the March 2022 shooting at Olathe East have withdrawn from the case.Attorneys Paul Morrison and Veronica Dersch moved to withdraw as the counsel for Jaylon Elmore, 20.Elmore’s next appearance will be at 1:30 p.m. on Jan. 10, 2024.He will be required to attend the hearing in person.Elmore was charged with attempted capital murder and possession of a firearm by a convicted felon. He also faces two misdemeanor counts involving criminal use of weapons.Olathe East school resource officer Erik Clark was wounded in the shooting, along with the school’s former assistant principal, Kaleb Stoppel.He will stand trial at a later date.The development came at a bond hearing on Wednesday.
