ARE SET TO CONTINUE TOMORROW MORNING. NEW MEXICO’S attorney GENERAL SAYS HIS OFFICE WILL OVERSEE COMPLIANCE IN THE 2018 YAZZIE MARTINEZ CASE. IN THAT CASE, THE JUDGE RULED THE STATE HAD FAILED TO MEET THE EDUCATIONAL NEEDS OF ENGLISH LANGUAGE LEARNERS AND INDIGENOUS CHILDREN IN OUR STATE. SINCE THEN, THE STATE’S BEEN UNDER COURT OVERSIGHT AS THEY’VE WORKED TO MEET THE REQUIREMENTS OF THAT RULING AT THE TIME, THE AG’S OFFICE ALLOWED THE PED AND THE GOVERNOR’S OFFICE TO HIRE THEIR OWN LAWYERS TO FIGHT THE CASE. NOW THE AG SAYS AFTER FIVE YEARS, IT’S TIME HIS OFFICE TAKES CONTROL OF IT. WE SHOULD BE FOCUSED ON THOSE KIDS AND WE SHOULD BE FOCUSED ON GETTING THE EXPERTS TOGETHER AND COMING UP WITH A CONCRETE PLAN. AND, YOU KNOW, I IN THIS CAPACITY HAVE THE ABILITY TO TO FORCE PEOPLE TO COME TOGETHER TO START HAVING THOSE HARD CONVERSATIONS BECAUSE THAT’S WHAT IT’S ULTIMATELY GOING TO TAKE. New Mexico’s attorney general says his office will oversee compliance in the 2018 Yazzie-Martinez case. A judge ruled the state had failed to meet the education needs of English language learners and Indigenous children in the state. Since then, the state has been under court oversight as they’ve worked to meet the requirements of the ruling. At the time, the attorney General’s Office allowed the Public Education Department and the governor’s office to hire their own lawyers to fight the case. Now, the attorney general says, after five years, it is time his office takes control of the case. “We should be focused on those kids and we should be focused on getting the experts together and coming up with a concrete plan,” attorney General Raul Torrez said. “And, you know, I, in this capacity, have the ability to force people to come together and start having those hard conversations, because that’s what it’s ultimately going to take.”In a statement, the governor’s spokesperson said, “We need to find a way to more directly hold school boards and school districts accountable for fully implementing the critical investments this administration has made over the last four years. The attorney general’s office has the power to do just that. We have raised this issue with sovereign nations, and they agree.””I’m not an education expert,” Torrez said. “I would never presume to try and dictate what the terms of that arrangement should be. But what I can do is create the context for experts to get together and the opposing parties to get together and start meeting and conferring in a meaningful way to develop this strategy. I think their frustration is real. Their frustration with the pace of change is understandable, especially because there was a sense that things would finally change when they won this court battle five years ago.”
