Closing statements heard in foster child abuse, death trial
A jury will return Monday to continue deliberations in a Longmont child abuse trial after attorneys made their closing arguments Friday.
Prosecutors told the jury Friday that common sense makes it clear that Cassidy Renee Lemmon is guilty of child abuse resulting in the death of 16-month-old Thomas Boyles, but the defense countered that the toddler’s health was the primary cause.
Closing statements came after a two-week long trial that included Lemmon’s former partner Vincent Ray Johnson testifying against her.

Lemmon, 25, and Johnson were co-foster parents to Thomas Boyles, who died April 24, 2019, at 16 months old. They were both arrested in 2019 on charges of child abuse resulting in death — Johnson pleaded guilty in 2021 and is currently serving a 12-year stipulated sentence.
According to the affidavit, at 5:47 p.m. April 22, 2019, Lemmon called 911 and said Boyles was unconscious and not breathing, according to the affidavit. When first responders arrived on scene, Lemmon was performing CPR on Boyles on his lower torso that was described by some as “a little deep.”
According to the affidavit, forensic pathologist Dr. Meredith Frank determined the boy died as a result of blunt force injuries to the head and trunk. In addition, Frank noted the presence of some healed rib fractures.
On Friday, the prosecutors and defense attorneys provided their explanations for the bruising and injuries that Boyles was shown to have in pictures leading up to his death.
Throughout the trial, Boyle’s noted injuries at the time of his death included a lacerated liver, injury to the pancreas, broken ribs, a spinal fracture and a large subdural hematoma.
The prosecutors argued Friday that the jurors’ common sense and life experience is enough to identify the injuries and bruises of Boyles as child abuse resulting in death.
“It is clear the defendant and her co-defendant Vincent Johnson were perpetrating physical abuse on Thomas Boyles over and over and over and they both knew it and they both did nothing but continue to hurt him,” Boulder County Chief Trial Deputy DA Christine Rinke said.
Prosecutors also said Lemmon covered up the abuse by “hiding behind closed doors” for months by rescheduling appointments with case workers and using excuses like “head banging” to explain the bruising to friends and family.
The prosecution noted that both Johnson and Lemmon had testified that they had witnessed each other abusing Boyles.
The prosecution also argued against the defense’s expert witnesses by pointing to the amount of money they were paid to testify and their disagreement with a number of other experts for the prosecution. Boulder County Chief Trial Deputy DA Fred Johnson said the defense paid one expert $22,000 to work on the case.
The toy box that Lemmon said Boyles ran into before falling backwards was placed in front of the jury throughout a portion of the trial and during closing statements. The prosecutor pointed to the toy box and said that due to its height and padded exterior, it could not be the cause of the subdural hematoma that Boyles endured.
Defense attorney Brian Emeson argued Friday that the main cause of Boyle’s death was his natural health. While presenting the jury with images from the trial, the defense said Boyle’s bruising and death could be linked to multiple health complications including sepsis, chronic disseminated intravascular coagulation, pneumonia, thrombus, anemia, and herpes in the lungs.
The defense also argued that multiple people investigating the case had “tunnel vision” in which they believed it was a child abuse case from the start and therefore only looked for evidence that would support child abuse.
The defense connected Boyles’ broken ribs to the aggressive and incorrect CPR performed by Lemmons. However, the prosecutors responded by saying their expert witnesses said CPR, performed correctly or incorrectly, could not cause the broken rib injuries that Boyles endured.
In Emeson’s closing statements, he also argued that Vincent Johnson had admitted to abusing Boyles, including spanking and squeezing him. He said Vincent Johnson would get frustrated and was not equipped to take care of two children as he did the morning of the 911 call.
“Don’t let this tragedy in death become an injustice in life,” Emeson said to the jury.
Prosecutor Fred Johnson ended the closing statements by urging the jury to find Lemmon guilty.
“Every one of you knows what happened in this case,” he said. “Find her guilty of child abuse resulting in death.”
The jury is deliberated the case for about half a day Friday before being dismissed for the weekend.
